Sun Yang and Fina's counsel consistently argued that the WADA guidelines should not be interpreted under contract. WADA counsel misunderstood Sun Yang and Fina's position and proceeded to also argue against interpreting the WADA guideline as contract. Thus, it is proper for judges to interpret the WADA guidelines in light of all related statements, facts, histories and practices as a whole, without being constrained by the disclaimer "the guidelines has no legal status" in the WADA guideline. (If the WADA guidelines represented a part of a contract; then the intrinsic statements in the contract would govern the interpretation of the contract.) Looks like WADA counsel did not study the other side's argument properly. WADA counsel seemed arrogant by calling the other side's 100+ page brief as "tortured grammatical gymnastics." Maybe it is justified that WADA should pay the attorney fees and costs to Sun Yang if it loses this case.
