王立山拒绝检方提出的４０年刑期
纽黑文(2014年)十一月二十六日报道，王立山医生在周二的法庭听证时，当场回绝了检察官提议认罪的一级过失杀人和非法使用枪支，并回绝了对方提出的40年徒刑。
“我不希望做任何一种辩诉交易，”王医生告诉高等法院法官帕特里克·J·克利福德。 “我是无辜的。我打算来证明我的清白。“
王医生说，“如果检方提出让我今天回家，我会接受的。”
这样的商议并非来自检察官，高级助理检察官基尼Calistro。
王医生现已48岁。在这之前，法官克利福德曾警告他，如果进入陪审团审，一旦定罪，很可能面临高达６０年徒刑的谋杀罪，外加20年的试图谋杀（针对试图谋杀图尔妻子的指控）。如果非法使用武器罪名成立，还有更多刑期。
检察官Calistro对法官克利福德说，他曾征询过被害人图尔医生的家人，其家人希望刑期不少于60年监禁的状态。
检查官Calistro后来在法庭外表示，之所以提出40年刑期，是要求王医生放弃上诉。
在与法官克利福德见面后，王医生又被转去面见法官托马斯·奥基夫，而法官奥基夫是真正将要主持陪审团审的法官。暂定４月选择陪审员，5月初开始庭审。
像往常一样，王医生没有律师，他代表他自己，他发了一连串审前动议。其中一项动议要求法庭审查“康州司法体制和监狱如何操纵被告的记忆”，并要求查寻纽约到布鲁克林医院（王医生和图尔医生曾一起工作的地方）如何进行“残暴的医疗事故”的纪录。王指责图尔医生等人在那个医院造成他被解雇，终止了他的职业生涯。
法官奥基夫否决了这些动议，然后把注意力转向第263号动议。不同寻常的是，法官没有大声朗读这个动议，他掠过文字，然后问王医生：“这是真的吗？”
该议案的题目是：“发传票调看被称作图尔医生尸体的验证报告。”
王医生要求从康州的首席法医那儿调取记录，从布鲁克林医院，和从两个外州的州立机动车部门要记录，用以正确识别死者确实为图尔医生。”
在动议中，王说，验尸官办公室表示，“死者”的身高5英尺10英寸。但是，“按照被告的记忆，图尔医生比5英尺10英寸矮的得多。显然，死者是不是图尔医生都值得怀疑。“
王的动议引用了李·哈维·奥斯瓦尔德的“照片分析”，那个被空在１９６３年暗杀肯尼迪总统的人案件。王引述这个“判例法”，奥斯瓦德的尸检报告称，他为5英尺9英寸高，但是他的海军陆战队报道记录他是6英尺1英寸。 “这就是差异，例如，这使许多研究者怀疑，在达拉斯被打死的奥斯瓦尔德可能不是那个没有出生在新奥尔良的奥斯瓦尔德”王说。

Dr. Lishan Wang Tuesday quickly rejected an offer from a state prosecutor to plead guilty to a reduced charge of first-degree manslaughter with a firearm and receive a 40-year prison sentence in the slaying of Dr. Vajinder Toor.
“I don’t want any kind of a plea bargain,” Wang told Superior Court Judge Patrick J. Clifford. “I am innocent. I intend to prove my innocence.”
Wang added, “If the state offered me (the chance) to go home today, I would accept that.”
Such an offer was not
forthcoming
from the prosecutor, Senior Assistant State’s Attorney Gene Calistro Jr.
Before Wang, 48, turned down the offer, Clifford warned him that if he goes to trial and is convicted by a jury, he could face up to 60 years on a murder count and another 20 on attempted murder: allegedly shooting at, but missing, Toor’s wife. Wang could get even more prison time if convicted on weapons charges.
Calistro told Clifford he has had ongoing discussions with the Toor family since Toor was shot in April 2010 outside his Branford home. Calistro said the family had requested an offer from the state of not less than 60 years in prison.
Calistro said later outside court that the 40-year deal would have prevented Wang from appealing his conviction on various legal grounds.
After his session in front of Clifford, Wang was brought across the hallway to the courtroom of Superior Court Judge Thomas V. O’Keefe Jr., who will preside over Wang’s trial. The tentative date to select jurors is sometime in April, with the trial to begin in May.
As usual, Wang, who is representing himself, had a list of pretrial motions. They included a motion to examine “how the Connecticut judicial system and state Department of Correction manipulate the defendant’s memory” and to look into the “atrocious medical malpractice” record of the Brooklyn, New Yorkm, hospital where Wang and Toor worked together. Wang blames Toor and others at that hospital for having him fired and ruining his career.
O’Keefe denied those motions, then turned his attention to motion number 263. Unlike with the other motions, O’Keefe did not read it aloud. He just skimmed the document, then looked at Wang and asked, “Really?”
The motion was entitled: “Subpoenaing documents for identification of the alleged decedent as Dr. Vajinder Toor.”
Wang asked that records be subpoenaed from the office of the Connecticut chief medical examiner, the Brooklyn hospital and two out-of-state departments of motor vehicles “in order to correctly identify the alleged decedent as Dr. Vajinder Toor.”
In the motion, Wang said the medical examiner’s office stated the body of “the alleged decedent” was 5 feet, 10 inches. But “as per defendant’s memory, Dr. Toor was much shorter than 5 feet, 10 inches. Automatically, there is a doubt about who the body in the medical examiner’s office was.”
Wang attached to his motion a “photo analysis” of Lee Harvey Oswald, who assassinated President John F. Kennedy in 1963. Wang quoted “case law” that Oswald’s autopsy report stated he was 5 feet, 9 inches tall but his Marine Corps records reported he was 6 feet, 1 inch. “It is discrepancies such as these which have caused many researchers to believe that the Oswald killed in Dallas may not have been the same Oswald born in New Orleans in 1939,” Wang wrote.
Wang added, “Eventually, Oswald’s body was exhumed and compared with his dentistry records.” (The body was in fact that of Oswald.)
Calistro objected to the motion. “He (Wang) has the autopsy photos. It is Dr. Toor.”
“This is a troubling motion,” O’Keefe told Wang. “It causes me to wonder whether you should represent yourself. This may be evidence of psychotic thinking.”
Wang replied, “I am in my career a scientist. This has nothing to do with being crazy or unreasonable or arrogant.”
“There’s no merit to this motion,” O’Keefe said. “One thing is not at issue: Dr. Toor is dead.”
“We need to verify it,” Wang said.
“I don’t agree with you,” O’Keefe told him and denied the motion.
O’Keefe then asked Wang about his progress in hiring experts, especially a psychiatrist. Wang said he will meet with that expert this week.
“The big issue now,” O’Keefe told Wang, “is you have to decide whether to pursue a defense of mental disease or defect or extreme emotional disturbance. I’m allowed to set a 45-day limit on that decision. I now impose it.”
